Q: Can a Landlord Inspect Without the Tenant?

Can I enter my rental property to do an exit inspection without the tenant being present?

A: In all circumstances where you plan to do an inspection of the property, you must first give your tenant written warning at least 24 hours in advance. This will give them enough time to acknowledge the visit and decide if they want to be present. NOTE: make sure you send this notification by recorded delivery, so you can prove that you gave them notice.

However, in this instance I recommend asking your tenant to be present at this inspection, especially if it is before they vacate. If for example you have completed a property inventory form throughout their tenancy agreement i.e. before and during, it is important that your inspection is done before they leave and that they are present throughout, to prevent any disputes over damages (they can claim the damages occurred after they left).

Of course whilst you are doing an inspection, you should always take photographs of the condition of the properties contents to act as visual proof; however by having your tenant present they cannot dispute your findings or allege it wasn't their fault.
