Q: Turning A Residential Property Into A Property Let

I would like to turn a property into a property let - what is the law surrounding this?

A:

If your property isn't already a property let, then by making it one it will automatically become an assured shorthold tenancy (AST) - this is of course unless you agree another form of tenancy in writing (i.e. you decide to take in a live-in lodger).

By becoming an assured shorthold tenancy, this will mean that:

  • You have a guaranteed right to regain possession of your property after 6 months
  • You can charge a market rent
  • You can regain possession of your property before the 6 months are up, if your tenant breaches their tenancy agreement and falls into rental arrears (at least 8 weeks rent must be owing for you to do this)
  • Your tenants can be evicted if they damage your property or are reported to be a nuisance to neighbours
