Q: Dealing with a leaving flatmate

One of our flatmates signed our tenancy agreement, even though she knew she wasn't going to go on the course or stay in the property. What should we do about her part of the rent?

A:

Working on the assumption that you all signed the same tenancy agreement, then you will all jointly and individually be responsible for the rent on the property. This means your flatmate will still be liable for her part of the rent even though she is not living in the property. However, you and your other flatmates will also be liable to your landlord for her share.

I recommend trying to find a replacement for your flatmate straight away, where you either all sign a new tenancy agreement or you check with your landlord to see if you are okay to take on a new person as a lodger.

Until then your flatmate should pay her part of the rent - and assuming she is a good friend she will - however you need to be prepared for the fact that she may refuse to pay (because she is not living there).

Because of this, you need to make it clear to her that she is legally responsible for this rent, and that any expenses incurred from having to sign a new agreement, covering reference costs etc is her responsibility.

Either way, the faster you act the better.
