Strictly you cannot enquire into whether your tenant is claiming housing benefits from your local authority unless they have given you prior written permission to speak to them about their claim (due to confidentiality). However, this would indicate that they are...
Of course if your tenant is claiming housing benefits, it would be to their advantage to tell you, because should they ever fall into rental arrears you can contact their local housing authority and ask them to pay their rent.
Similarly, by being honest with you, you can also arrange for their housing benefit allowance to be paid directly to you when their rent is due, thus making their life simpler...
My suggestion would be to talk to your tenant and ask them, especially if you are aware that they are on a low income, as they could be entitled to housing benefit and not even realise it.
Under current law, anyone who rents a property can essentially apply for housing benefit if they are on a low income and have got capital (in savings, shares and property) under £16,000.
